These Terms of Service govern your use of www.holylifters.com and purchases from Holy Lifters LLC (“Holy Lifters,” “we,” “us,” or “our”). Our online store is hosted by Shopify.

By using our website or placing an order, you agree to these terms and the policies referenced below, to the extent permitted by applicable law.

1. Eligibility and Account Information

You must be legally able to enter into a purchase agreement or have permission from a parent or legal guardian.

Provide accurate contact, payment, and shipping information. If you create an account, keep your login credentials secure and notify us of suspected unauthorized use.

2. Products and Availability

We sell apparel, accessories, and training gear. Many products are made to order through fulfillment partners, including Printful.

We aim to display accurate descriptions, photographs, size guides, and prices. Colors may appear different depending on your screen. Minor production variations may occur, but products must conform to their descriptions and applicable legal requirements.

Review the size guide for each product before ordering. Availability may change, and products may be discontinued.

3. Prices and Payments

Prices are displayed in U.S. dollars unless otherwise stated. Applicable shipping charges, taxes, and discounts are shown at checkout.

You authorize the selected payment provider to process the amount shown when you place your order. Price changes apply to future purchases and do not change amounts already agreed for existing orders.

Discounts are subject to their stated conditions and cannot be combined unless expressly permitted.

4. Orders and Errors

An order confirmation acknowledges receipt of your order. We may contact you if an item is unavailable, payment cannot be verified, or a material pricing or listing error affects your order.

We will not charge an increased price without your agreement. If we cannot fulfill an order, we will notify you and refund the affected items and applicable shipping charges.

We may refuse orders involving suspected fraud, unlawful activity, or misuse of our services, subject to applicable law.

5. Production, Shipping, and Delivery

Made-to-order products require production time before shipment. Production time and carrier transit time are separate unless an estimate expressly includes both.

Estimated timeframes are not guarantees unless expressly stated. Availability, production volume, holidays, and carrier conditions may affect delivery.

Contact us promptly about incorrect addresses, missing packages, or delays. We will investigate with the fulfillment partner or carrier and explain available solutions. Nothing in these terms removes rights concerning late or undelivered goods.

6. Changes and Cancellations

Contact holyliftersllc@gmail.com immediately to request a change or cancellation. Because products are made to order, requests cannot be guaranteed after production begins.

If cancellation is possible, we will confirm the refund and any applicable shipping adjustment.

7. Returns, Refunds, and Exchanges

Our "Return and Refund Policy" (https://www.holylifters.com/policies/refund-policy) forms part of these terms.

For eligible ordinary returns, contact us within 30 days of delivery. Items must meet the condition requirements in that policy. Customers pay return postage for change-of-mind, size, or color returns, and original shipping charges are not refunded for change-of-mind returns.

For confirmed defects, misprints, or incorrectly supplied items, we arrange a replacement or refund at no additional cost to the customer, including required return postage.

Orders placed before a policy change retain the terms offered when purchased. Applicable consumer rights remain unaffected.

8. Acceptable Website Use

You must not use our website to commit fraud, violate another person’s rights, transmit malicious software, interfere with security, or disrupt our services.

We may restrict access for violations of these terms. Restrictions do not eliminate our obligations concerning existing purchases or refunds.

9. Intellectual Property and Reviews

Holy Lifters branding, original designs, photographs, and website content belong to us or our licensors. Purchasing a product does not grant permission to reproduce our designs or use our branding commercially.

You retain ownership of reviews or other content you submit. By submitting a review for publication, you permit us to display it and make reasonable formatting edits without changing its meaning. Do not submit unlawful content, another person’s private information, or material you lack permission to use.

10. Privacy and Third-Party Services

Our "Privacy Policy" (https://www.holylifters.com/policies/privacy-policy) explains how personal information is handled.

Third-party websites and services have their own terms and privacy practices. Holy Lifters remains responsible for its obligations as the seller, including when fulfillment partners assist with an order.

11. Service Availability and Liability

We do not guarantee uninterrupted or error-free website access. We may perform maintenance or modify website features.

To the extent permitted by law, we are not liable for indirect or consequential losses arising from website use. Nothing in these terms excludes liability that cannot lawfully be excluded, limits mandatory product warranties, or removes rights concerning defective, misdescribed, or undelivered goods.

12. Governing Law and Disputes

Massachusetts law governs these terms, except where mandatory laws applicable to you provide otherwise.

Please contact us first so we can try to resolve concerns. These terms do not require arbitration or waive access to courts or other remedies available under applicable law.

13. Updates and Severability

We may update these terms for future use and purchases. We will revise the date above and provide additional notice where required. Changes do not retroactively reduce rights associated with existing orders.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
